SC dismissed a petition challenging UPSC’s decision over the quota of some students.
As per the rules, candidates appearing for the UPSC Civil Services Examination 2022 must have submitted their income and asset certificates by February 22, 2022.
On Monday, the Supreme Court of India dismissed a writ petition filed by some civil service aspirants contesting the Union Public Service Commission’s (UPSC) decision to categorise them as general category candidates.
The UPSC took this step because these aspirants had not submitted the necessary Economically Weaker Section (EWS) certificates before the prescribed cut-off date for the Civil Services Examination (CSE) 2022.
According to the apex court’s ruling, these aspirants will continue to be treated as general-category candidates for the CSE. The court affirmed that UPSC was correct in denying the candidates’ claims for the EWS quota due to their failure to submit certificates before the specified deadline.
A bench comprising Justices JK Maheshwari and KV Viswanathan stated that the constitutionality of the law and rules had been maintained in the results of the Civil Services Examination 2022. Justice Vishwanathan, who delivered the judgment, noted that candidates seeking benefits under the EWS category in CSE 2022 would have only been considered eligible if they had submitted their certificates in accordance with the dates and criteria set by the central government.
As per CSE rules, candidates participating in the Civil Services Examination 2022 were required to submit their income and asset certificates by February 22, 2022. Any candidate without the specified income and asset certificate could not avail of the benefits of the EWS category. In DAF-1, documents valid until February 22, 2022, had to be submitted online by the due date.
The SC bench further affirmed that UPSC was correct in rejecting the candidature of those candidates seeking benefits under the EWS category, as they had not submitted the income and asset certificates within the stipulated time frame. Conversely, the petitioners challenged that this action was arbitrary and contravened Articles 14, 16 and 21 of the Constitution.
The Supreme Court maintained that UPSC was correct in determining the format and deadline for document submission.
